Terms of Service

These terms cover your use of Tend. By using the service you agree to them. Tend is in early access, so a few of these terms reflect that we're still building - we'll update this page as things settle. Questions go to hello@tend.support.
Accounts and access
We create each workspace by hand and invite agents into it. You are responsible for keeping your login credentials safe and for the actions taken by the agents you invite. Tell us promptly if you believe an account has been compromised.
Acceptable use
You agree not to use Tend to:
- break the law or infringe someone else's rights;
- send unlawful, harmful, or abusive content, or upload malware through tickets, attachments, or portals;
- probe, disrupt, or attempt to gain unauthorised access to the service or other tenants' data;
- resell or expose the service to third parties except through the customer portals it provides.
Your customers' data
Tend lets you work tickets on behalf of your own requesters and customers. You are responsible for that data - for having a lawful basis to hold it, for what you put into Tend, and for how you communicate with the people it concerns. Each customer portal is isolated to its own tenant.
Availability
During early access the service is provided as-is and as-available, without a formal uptime commitment. We aim to keep Tend fast and reliable and to warn you before any planned disruption, but we can't promise it will be uninterrupted or error-free while we build.
Fees
Plan pricing is shown on our pricing page. During early access, billing arrangements are handled directly- there is no self-serve checkout yet, and we'll agree fees and terms with you when we provision your workspace.
Termination
You can stop using Tend and ask us to close your workspace at any time. We may suspend or end access if these terms are breached or if we must do so to protect the service or other customers. On termination you can request an export of your data before it is removed.
Limitation of liability
To the extent permitted by law, Tend is not liable for indirect or consequential loss, or for lost data, profits, or revenue arising from your use of the service. Nothing in these terms limits rights that cannot lawfully be excluded, including under the Australian Consumer Law.
Governing law
These terms are governed by the laws of Australia, and the courts of Australia have jurisdiction over any dispute.
